Yahoo makes me laugh sometimes...
anyways i typed in the search term "free ebooks" in Yahoo and noticed one of my sites is listed #1 AND #2
however the #2 result is linked to a page from the old site which isn't functional since we changed it (first link goes to the new site)
what should I do with the #2 URL?
if I redirect it to the new site do i risk duplicate content issues?
any suggestions?

If so, I would simply create a small (1-5 pages) site about the topic that also explains that the main site has moved and directs visitors to the main site. That way Yahoo will not detect it as the same site and you keep both Yahoo listings.
If the old and new site are hosted on different IP addresses, the Page Rank from the old site will also improve the rank of the new site when you link to it, (with appropriately chosen keywords in the link text of course
)
Relevant Yahoo listings really help you in Google search results, it would be a shame to waste it, (Assuming you are talking about a directory listing of course).

if you redirect with a 301 - 'moved permanently' then you will not suffer duplicate content filters
if you redirect with a 302 - 'moved temporarily' then you will suffer duplicate content filters

Hyup.. North has it... you should always do re-directs from old pages since they may lose the rankings alltogether if it gets a 404
